PRIVACY POLICY FOR SENDING COMMUNICATIONS ON NEW PRODUCTS CONCERNING PERSONAL DATA PROTECTION PURSUANT TO ARTICLE 13 REGULATION (EU) 2016/679
Pursuant to Article 13 of Regulation (EU) 2016/679, Scart S.r.l. located at Nucleo Pianacci 28 – 52011 Bibbiena (AR), having VAT number 00113990519 and email info@grupposcart.com, acting as Data Controller, hereby informs users about the processing of personal data deriving from subscription to the newsletter by filling out the Contact Form section.
The Data Controller and Data Protection Officer
The Data Controller is SCART S.r.l. located at Nucleo Pianacci 28 – 52011 Bibbiena (AR), having VAT number 00113990519 and email info@grupposcart.com. The Data Controller has appointed a Data Protection Officer, who can be contacted via the email address dpo@scart.it.

Users of the website interested in contacting the Data Controller by completing the contact form.
Data processed
The data processed is:
- Personal data (name, surname);
- Contact details (email address).
Processing purposes
The purpose of the processing is to: a) detect the requests submitted by the user; b) subscribe to the Company’s Newsletter for the transmission of marketing communications.
Nature of the transfer and legal basis for processing
The legal basis of the processing for the purposes referred to in point a) is represented by the adoption of pre-contractual measures applied at the request of the Data Subject pursuant to Article 6(b) of Regulation EU 679/2016. The legal basis for the purpose indicated in point b) of the previous document is the Data Subject’s consent pursuant to Article 6(a) of Regulation EU 679/2016. The provision of data for the purposes referred to in point a) is mandatory in order to fulfil the request. The provision of data for the purposes referred to in point b) is optional. Refusal to provide the data shall not result in any negative consequences except to render it impossible for the Data Controller to process requests to send the newsletter. The legal basis of the processing is the consent to the processing of the aforementioned data, pursuant to Article 6(a) of Regulation EU 679/2016. Consent is considered given by flagging the appropriate boxes at the bottom of the online form. Consent is always revocable.
Processing methods
Data processing is carried out through computerised or electronic means and with hard copy media by internal or external subjects specifically appointed, authorised and committed to confidentiality. The data is processed and stored with suitable tools to ensure its security, integrity and confidentiality through the adoption of appropriate measures as required by law.
Conservation times
Personal data will be stored in a form that allows the same to be identified for a period of time not exceeding the achievement of the purposes for which the data was collected. It will thus be stored for up to 5 years from the transmission of the data. The data with a purpose represented by consent will be kept in a form that allows identification for the Data Subject for two years from registration, it being understood that upon revocation of consent with the opt-out technique, the Data Controller shall proceed with the erasure of their data.
Communication, dissemination and transfer
The data collected will not be disseminated, sold or exchanged with third parties without the express consent of the Data Subject, except for any communications to authorised third parties likewise committed to confidentiality or whereby appointed as Data Processors pursuant to Article 28 of Regulation (EU) 2016/679. Upon request, the complete and up-to-date list of Data Processors can be found through the methods indicated in this Policy. Your data may be communicated to the other Group companies solely for administrative purposes and for entering into contracts. The data may be communicated to the competent authorities, according to the terms of the law.
Data shall not be transferred outside the European Union.
Rights of the Data Subjects
At any given time, Data Subjects may access their personal data, request corrections, updates and the erasure of said data. Data Subjects may also deny processing and request its limitation.
The rights may be exercised by sending:
- A registered letter with return receipt to Scart S.r.l. at Nucleo Pianacci 28 – 52011 Bibbiena (AR);
- A certified email to the address scart.imballaggi@pec.it;
- An email to the Data Protection Officer via dpo@scart.it.
The right to revoke consent may be exercised through a specific link at the bottom of each communication for marketing and promotional purposes. This link will allow you to access a specific section where you can request deletion from the mailing list and revoke your consent to receiving promotional material. Moreover, if processing is deemed to have been carried out in violation of the law regarding personal data protection, Data Subjects have the right to lodge a complaint with the Data Protection Authority at Piazza Venezia 11 – 00187 Rome.
